Terms of service

These terms govern the use of ProductZephyr. They are accepted when a workspace is opened, and they are the contract between us for as long as one exists. They are written for businesses — the service is not offered to consumers.
Who you are contracting with
Vincent Haas EI, referred to here as “we”. “You” means the business that opened the workspace; the person who opened it warrants that they may bind it. A subscription taken from inside the workspace is sold by Paddle.com Market Ltd, our authorised reseller and merchant of record: Paddle is the seller on that purchase and issues the invoice for it, while the service itself is provided by us under these terms.
What the service is
ProductZephyr holds your product data and renders it into documents — datasheets, catalogues, price lists — as PDF, images or slides. It is provided as a service over the internet: there is nothing to install, and we operate, maintain and update it. Features may change; anything that removes something you depend on is announced beforehand.
The trial
A new workspace runs for thirty days at no charge, with no card and no obligation. When the trial ends the workspace becomes read-only: your data stays, you can still read it and take it out through the round-trip spreadsheet export, and nothing is deleted for having expired. A workspace that was opened and never used is deleted sixty days after the trial ends, and we write to you before that happens.
Price and payment
Prices are those published on productzephyr.com on the day you subscribe, exclusive of tax. Subscriptions are monthly and payable in advance; there is no annual plan. A subscription taken from inside the workspace is paid by card at Paddle’s checkout, and Paddle works out and collects whatever tax is due — a business in the European Union that enters a valid intra-community VAT number is not charged VAT. Where we invoice you directly instead, payment is by transfer, and a business established in the European Union outside France must give us a valid intra-community VAT number, the reverse charge then applying.
Refunds
The thirty-day trial stands in place of a refund policy: nobody pays before having used the service for a month. A period that has begun is not refunded, and cancelling takes effect at the end of it rather than the day you ask. Where Paddle is the seller it keeps, under its own terms, a discretion to refund a buyer, which it may exercise whatever this paragraph says.
Your data stays yours
Everything you put into ProductZephyr — products, attributes, documents, templates — remains yours. We claim no ownership and no right to use it beyond running the service for you. You can export the whole catalogue at any time, in a spreadsheet that can be read without us. Personal data is covered by the privacy policy, which forms part of these terms.
What we may not do
We do not sell, share or mine your data. We access a workspace only to operate the service or when you ask us for help, and every such access is recorded in that workspace’s own audit trail, naming who and when.
What you may not do
You may not use the service unlawfully, put data in it that you have no right to hold, resell access to it, attempt to reach another workspace, or place a load on it designed to degrade it for others. An account may be suspended for any of these, and we will tell you why.
Availability
We aim to keep the service available at all times and to keep backups from which it can be restored. We do not promise it will never be interrupted: maintenance, a provider incident or a failure can take it down.
Liability
Nothing here excludes liability that the law does not allow to be excluded. Subject to that: we are liable for direct damage caused by our fault, capped at the amounts you paid over the twelve months before the event; and we are not liable for indirect loss, in particular loss of profit, of business, or of data you were able to export.
Ending it
You may stop at any time, with effect at the end of the period already paid for, without notice or penalty. We may end the contract for a serious breach of these terms, or with two months’ notice for any other reason. When it ends you have thirty days to export your data, after which the workspace and everything in it is deleted — including from our backups, once their own retention has run out.
Changes to these terms
We may change these terms. Any change that affects your rights or the price is announced by email at least thirty days beforehand, and you may end the contract before it takes effect rather than accept it.
Law and jurisdiction
These terms are governed by French law. If a dispute cannot be settled between us, it goes before the courts of Strasbourg. Neither of us is prevented from seeking urgent relief where the law allows it.
